SQ Edutechh respects the privacy of users and is committed to protecting personal information. This Privacy Policy sets out the manner in which personal data is collected, processed, stored, disclosed, and safeguarded when users access the website or avail services of the Company.

It further outlines the rights available to individuals in relation to their personal data. Data Principals may also request erasure of personal data where such retention is no longer necessary for the purpose for which it was collected, subject to legal or regulatory obligations.

1. Organization and Scope

SQ Edutechh, having its registered office at D 308 Crystal Plaza, Link Road, Opposite Infinity Mall, Andheri West, Mumbai – 400053, Maharashtra, India, is responsible for the collection and processing of personal data covered under this Policy. For the purposes of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the Company acts as a Data Fiduciary.

This Privacy Policy applies to personal data collected through the website, during counselling sessions, in connection with university applications, visa processing, and education loan facilitation services. This Policy does not extend to third-party institutions, universities, financial entities, or external websites.

2. Information Collected

The Company may collect personal data including identity details, contact information, academic records, financial documentation, and technical usage data. Personal data is collected when voluntarily provided by the User or automatically through technological tools such as cookies.

Identity & Contact Details Includes name, date of birth, nationality, passport information, government-issued identification numbers, residential address, email address, and phone number.
Academic Records Includes transcripts, test scores, certificates, and letters of recommendation.
Financial Information Includes income details, bank statements, loan documentation, and sponsor details.
Technical Usage Data Includes IP address, browser type, device information, and website interaction data.

3. Purpose of Collection & Data Minimisation

Personal data is processed for lawful and legitimate purposes directly connected with the services offered by the Company. Such purposes include providing study abroad counselling, facilitating university applications, assisting with visa documentation, referring education loan applications to financial institutions, communicating service-related information, maintaining records, and complying with legal obligations. The Company processes personal data only for specific and lawful purposes consistent with the nature of its services.

Data Minimisation & Purpose Limitation: The Company shall collect and process personal data only to the extent that is necessary for the lawful and legitimate purposes connected with the services requested by the User. Personal data collected shall be limited to information that is relevant and reasonably required for purposes including study abroad counselling, university application facilitation, visa documentation support, and education loan referral services.

The Company shall not collect or process personal data that is excessive, unrelated, or unnecessary for the specified purpose of processing. Personal data shall not be retained or used for any purpose other than the purpose for which such data was originally collected, except where such processing is required for compliance with applicable laws, regulatory obligations, dispute resolution, or enforcement of contractual rights. Where personal data is no longer necessary for the purpose for which it was collected, the Company shall take reasonable steps to securely delete, anonymize, or otherwise cease processing such data in accordance with applicable law.

4. Legal Basis for Processing & Explicit Consent

Processing of personal data is undertaken on the basis of consent provided by the User, performance of contractual obligations, compliance with applicable laws, and other lawful purposes permitted under the DPDP Act. Electronic consent provided through website interaction or execution of service agreements constitutes valid acceptance under Section 10A of the Information Technology Act, 2000.

Explicit Consent for Disclosure of Sensitive Information

Certain services provided by the Company may require the collection and processing of sensitive personal information including, but not limited to, passport details, financial records, bank statements, academic transcripts, identification documents, and other supporting documentation required for university admissions, visa applications, or education loan processing.

By voluntarily submitting such information to the Company through the website, email communication, physical documentation, or any other mode of interaction, the User expressly provides informed consent for the Company to process and disclose such information to relevant third parties for the purpose of providing the requested services. Such third parties may include foreign universities, financial institutions, visa authorities, documentation partners, and regulatory authorities where required.

The User acknowledges and expressly agrees that such disclosure is necessary for the completion of university applications, visa documentation, or financial assessments and agrees that the Company shall not be responsible for the processing of such information by third parties once the information has been lawfully shared in accordance with the provisions of the Digital Personal Data Protection Act, 2023 and other applicable laws. The Company shall ensure that such information is disclosed only to the extent reasonably necessary for the specified purpose.

5. Minor Data

Where the student is below eighteen (18) years of age, verifiable consent of a parent or legal guardian is mandatory. The parent or legal guardian shall act as the lawful representative of the minor and shall assume responsibility for authorizing the processing of personal data. The Company does not knowingly process personal data of minors without appropriate parental authorization.

6. Data Sharing & Processing Flow

Personal data may be shared with foreign universities, educational institutions, financial institutions, visa consultants, documentation service providers, payment processors, and government authorities, strictly for purposes related to service delivery and regulatory compliance. The Company does not sell personal data to third parties.

Personal data provided by the User may be processed by the Company and disclosed to third parties strictly for the limited purpose of providing the services requested by the User and for fulfilling lawful obligations connected with such services. Depending on the nature of the services sought by the User, personal data may be shared with relevant entities including, where necessary:

  • Foreign universities or educational institutions for the purpose of admission processing and academic evaluation.
  • Financial institutions or lending partners for the purpose of facilitating or referring education loan applications.
  • Visa consultants, documentation partners, or immigration service providers assisting with visa or immigration related procedures.
  • Payment processing service providers for facilitating secure payment transactions.
  • Government authorities, regulatory bodies, or statutory agencies where disclosure is required under applicable law.

Such disclosure shall be limited strictly to the extent necessary for the purpose for which the personal data was originally collected and processed. The Company shall undertake reasonable measures to ensure that any third party receiving such data processes the information solely for the specified purpose and in accordance with applicable laws.

7. Third-Party Responsibility Disclaimer

The Company may, in the course of providing its services, disclose or transfer personal data of the User to third-party entities including foreign universities, financial institutions, visa consultants, documentation service providers, payment processors, and government or regulatory authorities for purposes directly connected with the services requested by the User.

Upon such disclosure made with the consent of the User and in accordance with the provisions of the Digital Personal Data Protection Act, 2023, the receiving entity shall process such personal data as an independent data fiduciary or data processor, as applicable, under applicable law. The Company shall take reasonable steps to ensure that such disclosures are made only for legitimate service-related purposes and in accordance with lawful processing requirements. However, the Company shall not be responsible or liable for any act, omission, negligence, misuse, unauthorized disclosure, or data processing practices undertaken by such third parties after the personal data has been lawfully shared.

The User acknowledges that once personal data is transferred to such third-party institutions or authorities for the purposes of application processing, visa facilitation, financial assessment, or regulatory compliance, the further use, retention, or disclosure of such data shall be governed by the privacy policies and legal obligations of the respective third party.

Nothing contained in this Policy shall be construed as creating any partnership, agency, or joint-control relationship between the Company and such third-party entities with respect to the processing of personal data.

8. Consent Withdrawal and User Responsibility

Consent Withdrawal

The User may withdraw consent for the processing of personal data at any time in accordance with the provisions of the Digital Personal Data Protection Act, 2023 by submitting a written request to the Company.

However, the User acknowledges that withdrawal of such consent may affect the ability of the Company to continue providing services including, but not limited to, university application processing, visa documentation assistance, or education loan facilitation. Upon withdrawal of consent, the Company shall cease processing personal data to the extent required under applicable law, except where retention or processing of such data is necessary for compliance with legal obligations, enforcement of contractual rights, dispute resolution, or regulatory requirements. The Company shall not be responsible for any consequences arising from the withdrawal of consent by the User where such withdrawal prevents the completion of services requested by the User.

User Responsibility for Accuracy of Information

The User represents and warrants that all personal information, academic records, financial documents, and other materials submitted to the Company are accurate, complete, and genuine. The Company relies on the information and documentation provided by the User for the purpose of facilitating university applications, visa documentation, and education loan referrals. The Company does not independently verify the authenticity of all documents provided by the User unless specifically required by law.

The User acknowledges that submission of inaccurate, incomplete, misleading, or fraudulent information may result in rejection of applications by universities, visa authorities, or financial institutions. The Company shall not be liable for any loss, rejection of application, visa refusal, loan rejection, or other adverse consequences arising from inaccurate or fraudulent information provided by the User.

9. Cross-Border Data Transfer

Due to the international nature of services provided, personal data may be transferred outside India, including to jurisdictions such as the United States of America, Canada, the United Kingdom, Australia, France, Germany, New Zealand, Ireland, and the United Arab Emirates.

Such transfers are undertaken solely for legitimate application processing and in accordance with applicable provisions of the DPDP Act. By availing services of the Company, users provide consent for such cross-border data transfers.

10. Data Retention & Security

Data Retention

Personal data is retained only for as long as necessary to fulfil the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce contractual rights. Upon expiry of the applicable retention period, personal data shall be securely deleted or anonymized in accordance with applicable law.

Data Security

The Company implements reasonable technical and organizational measures to safeguard personal data against unauthorized access, alteration, disclosure, or destruction. Such measures include secure server infrastructure, controlled access protocols, and internal confidentiality safeguards. While reasonable security practices are adopted, no digital system can guarantee absolute security.

Personal Data Breach Notification: In the event of any personal data breach involving unauthorized access, disclosure, alteration, or loss of personal data, the Company shall take reasonable steps to mitigate the impact of such breach and shall notify the affected Data Principals and competent authorities and the Data Protection Board of India in accordance with the provisions of the Digital Personal Data Protection Act, 2023 and any rules framed thereunder.

11. Rights of Data Principals

Subject to applicable law, individuals may exercise rights including the right to access personal data, request correction of inaccurate information, withdraw consent, and seek grievance redressal. Requests may be addressed to info@sqedutechh.com. Withdrawal of consent may affect the ability of the Company to provide certain services.

Right to Nominate: In accordance with Section 10 of the Digital Personal Data Protection Act, 2023, the Data Principal shall have the right to nominate another individual who may exercise the rights of the Data Principal under applicable law in the event of death or incapacity of the Data Principal.

12. Third-Party Links & Policy Updates

Third-Party Links: The website may contain links to external platforms. The Company is not responsible for the privacy practices or content of such third-party websites. Users are advised to review the privacy policies of external platforms before sharing personal information.

Updates to this Policy: The Company reserves the right to amend or update this Privacy Policy to reflect changes in legal requirements or operational practices. The revised version shall become effective upon publication on the website.
